Terms of Service

1. Acceptance

By accessing or using BuildsDrop (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. These Terms apply to all users, including uploaders and recipients of shared build files.

2. Description of Service

BuildsDrop is a developer tool that allows users to upload mobile application binaries (.apk for Android, .ipa for iOS), generate shareable links and QR codes, and share those links with testers or collaborators for direct installation. BuildsDrop is designed for distributing builds you own or are authorized to distribute.

3. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement.

4. Uploader Responsibilities

When you upload a file, you represent and warrant that:

• You are the developer of the application, or have explicit authorization from the owner to distribute this build.
• The build does not contain malware, spyware, adware, or any code designed to harm, deceive, or exploit end users or their devices.
• The build does not infringe any third-party intellectual property rights, including copyright, trademark, or patent rights.
• The build does not contain or facilitate illegal content or activities.
• You have obtained all necessary consents and rights to collect and process any personal data that the application may handle.

By clicking "I have the right to distribute this build and agree to the Terms," you confirm the above representations. Your acceptance is recorded with a timestamp and the version of these Terms for auditing purposes.

5. Prohibited Content

You may not upload builds that:

• Contain or distribute malware, ransomware, trojans, or other malicious software.
• Are pirated, cracked, or reverse-engineered copies of commercial software.
• Violate any applicable law or regulation.
• Contain child sexual abuse material (CSAM) or any exploitative content.
• Are designed to deceive users (e.g., phishing or credential-harvesting apps).
• Infringe the intellectual property rights of any person or entity.

BuildsDrop reserves the right to remove any build and suspend any account that violates these prohibitions, with or without prior notice.

6. Security Notice

BuildsDrop does not perform automated malware scanning of uploaded files. Users who download and install builds from BuildsDrop do so at their own risk. We recommend that uploaders only share builds with trusted recipients, and that recipients only install builds from developers they trust.

Automated malware scanning is planned for a future release (Phase 3). See our roadmap for details.

7. iOS OTA Installation

iOS Over-The-Air (OTA) installation requires that the IPA be signed with either an Ad-Hoc provisioning profile (with the target device's UDID registered) or an Apple Enterprise distribution certificate. BuildsDrop cannot bypass Apple's code signing requirements. The uploader is solely responsible for proper signing.

OTA installation also requires a valid HTTPS certificate. The uploader is responsible for ensuring the host serving the manifest and binary files is reachable over HTTPS.

8. Link Expiry and Data Retention

Uploaded builds may be configured to expire after a specified number of days or set to "Forever" (no expiry). Expired builds have their binary files deleted from storage; metadata rows may be retained for analytics unless thePURGE_METADATA_ON_EXPIRY flag is enabled. BuildsDrop reserves the right to delete inactive builds to manage storage capacity.

9. Intellectual Property

BuildsDrop does not claim ownership of the files you upload. You retain all intellectual property rights in your builds. By uploading, you grant BuildsDrop a limited, non-exclusive license to store and serve the file as necessary to operate the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. BUILDSDROP DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR CONTINUOUSLY AVAILABLE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUILDSDROP AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

12. DMCA / Takedown

If you believe that content on BuildsDrop infringes your copyright, please send a notice to our designated agent containing: (i) a description of the copyrighted work; (ii) the URL of the infringing content; (iii) your contact information; and (iv) a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner.

13. Changes to Terms

We may update these Terms from time to time. When we do, we will update the version number and effective date at the top of this page. Continued use of the Service after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which the operator is based, without regard to conflict-of-law principles. Any disputes shall be resolved in the competent courts of that jurisdiction.
